Donald Trump’s first pretrial session in his historic criminal case involving the handling of sensitive documents is scheduled to be presided over by a Florida judge who presided over a court decision last year that critics claimed was unfairly favorable to Trump.
Before U.S. District Judge Aileen Cannon, prosecutors and defense attorneys will outline the guidelines and procedures that will control how secret material is utilized in the case. It’s a typical topic for any prosecution involving secret information, but it’s noteworthy because Cannon will be hearing arguments in the case for the first time since the former president was charged last month.
The Classified Information Procedures Act, enacted in 1980, will be the subject of the arguments on Tuesday. The participants in a criminal investigation must abide by the statute’s rules for the handling of classified material. It aims to strike a balance between the government’s desire to protect important and secret information and a defendant’s right to view evidence that prosecutors plan to utilize in a case.
Prior to the pretrial session, the office of special counsel Jack Smith sought Cannon to issue a protective order that would, in part, prevent defense attorneys from discussing sensitive case information with Trump and his co-defendant and assistant, Walt Nauta. Prosecutors said in their request for the order that defense counsel informed them “that they intend to object to certain provisions of the proposed protective order, but did not specify any such provisions.”
In response to a 38-count indictment, which accuses Trump and Nauta of conspiring to conceal from Justice Department investigators secret materials that were carried from the White House to Mar-a-Lago in January 2021, Trump and Nauta have entered a not-guilty plea.
Tuesday’s hearing is not anticipated to have either Trump or Nauta present.
The timing of the trial may also become an issue on Tuesday. The trial is scheduled to start on December 11, according to the prosecution, but Trump’s legal team, who is running for the Republican presidential nomination in 2024, has urged delaying it until after the election.
Additionally, Cannon presided over a complaint that the Trump campaign filed last year regarding the FBI search of Mar-a-Lago in August 2022. For approving Trump’s request for a special master to conduct an independent assessment of the sensitive materials removed by the FBI from Mar-a-Lago, Cannon faced criticism and second-guessing from legal experts.
Later, a three-judge federal appeals court overturned that decision and declared the judge lacked the power to make that decision.
