In an off-campus residence on November 13, 2022, Kaylee Goncalves, 21, Madison Mogen, 21, Xana Kernodle, 20, and Ethan Chapin, 20, are allegedly stabbed by Kohberger, 28, a former graduate student in criminology at Washington State University. After a six-week investigation, he was apprehended on December 30 and charged with four charges of first-degree murder and one count of criminal burglary.

“The State gives this notice based on the fact that it has not identified or been provided with any mitigating circumstances sufficient to prohibit the triers of fact from considering all penalties authorized by the Idaho legislature, including the possibility of a capital sentence,” prosecutors wrote in a court document submitted on Monday. The State is required to file this notice of intent to seek the death penalty in light of all the evidence that is currently known to the State.

A court entered not-guilty pleas on the suspect’s behalf last month. When the judge inquired about Kohberger’s readiness to enter a plea, Kohberger’s attorney replied that she and Kohberger would be “standing silent.” The judge then entered pleas of “not guilty” on Kohberger’s behalf.

Kohberger was allegedly confirmed to be responsible for the crime after leaving DNA traces on a knife sheath that was discovered at the site, according to an affidavit. Police used cell phone data to establish Kohberger’s presence near the home, a car of interest spotted around the house at the time of the murders, and trash from his home that was found during a search warrant to match his DNA.

The deliberate murders of the four students attracted a lot of public interest. In January, a judge issued a gag order prohibiting participants in the case including attorneys, and law enforcement from discussing it outside of court. Later, in June, the gag order was reduced in scope.
