A convicted fraudster who received a pardon from Trump is accused of fraud once more.
Eliyahu Weinstein is claimed to have admitted to others involved in the $35 million Ponzi-like scheme that he was accused with running that “I have a bad reputation,” according to officials.
Former President Donald Trump pardoned a con artist from New Jersey with a “bad reputation” two years ago; now, the man has been detained once more on suspicion of defrauding investors of millions of dollars.
In a “Ponzi-like scheme,” Eliyahu “Eli” Weinstein and four other men are accused of defrauding more than 150 people out of $35 million, according to an arrest complaint that was unsealed in Trenton federal court on Wednesday and a statement from the U.S. attorney’s office for New Jersey.
Weinstein and the others allegedly started “orchestrating another substantial scheme to defraud investors” shortly after his release from jail in January 2021 while still on probation, according to the lawsuit. They did this by creating a business named Optimus Investments Inc. under the alias Michael Konig.
In the release from the Justice Department, Special Agent in Charge James E. Dennehy of the FBI’s Newark field office stated, “We allege Mr. Weinstein took part in a new scheme to rip off investors by hiding his real identity.” “We allege he engaged in criminal activity despite knowing his actions were against the conditions of his release following a prior conviction for investment fraud.”
The gang is charged with “falsely claiming” to have negotiated “lucrative deals” on N95 Covid masks, “scarce baby formula,” and “first-aid kits headed for Ukraine.”
In addition, according to officials, the men planned to conceal Weinstein’s riches, which “should have been used to pay over $200 million in restitution” he owed to the victims of his first Ponzi scam.
Investigators allegedly acquired “surreptitious audio” recordings of meetings Weinstein allegedly attended with two unnamed co-conspirators and his claimed accomplices beginning on August 26. It is stated that during these conversations, Weinstein supposedly admitted that he was using the Konig pseudonym “because I have a bad reputation.”
According to the complaint, Weinstein, 48, Aryeh Bromberg, 49, Joel Wittels, 57, Shlomo Erez, 55, and Alaa Hattab, 34, are all accused of conspiring to commit wire fraud and to obstruct justice.
The five men could each spend up to 25 years in prison and pay fines of “either $250,000 or twice the gain or loss from the offense, whichever is greatest,” according to a statement from the Justice Department.
Except for Wittels, who lives in Lakewood, New Jersey, like Weinstein and Bromberg, and Hattab, who resides in Ottawa, all have been detained, the statement claims. Living in Israel is Erez.
The complaint claims that the suspected unnamed co-conspirators, who managed a business called Tryon Management Group and initially were not aware that Weinstein was Konig, had not been charged.
The statement read: “Once the Tryon owners learned that Mike Konig was really Weinstein, they agreed with the defendants to continue hiding Weinstein’s identity from investors and to raise additional funds to repay existing Tryon investors, all in an effort to prevent the Ponzi scheme from collapsing and to hide the fraud.
A legal complaint against Weinstein has also been made by the Securities and Exchange Commission.
In the dying hours of his presidency in January 2021, Trump pardoned 74 people, including Weinstein.
The group includes Steve Bannon, the former top strategist for Donald Trump, Elliott Brody, the former finance head of the Republican National Committee, Dwayne Michael Carter Jr. (also known as Lil Wayne), and Albert J. Pirro Jr., the ex-husband of Fox News personality Jeanine Pirro.
For his part in a $200 million real estate Ponzi scam that preyed on his neighbors in the Orthodox Jewish enclave of Lakewood, where he lives, Weinstein had already spent eight years of a 24-year sentence at that point.
Among those who backed his commutation were Alan Dershowitz, a defense lawyer, former Rep. Bob Barr of Georgia, and Brett Tolman, the former US attorney for Utah.
