A sexual assault complaint brought by a former Army colonel against Air Force Gen. John Hyten, who served as vice chairman of the Joint Chiefs of Staff, has been settled in court for about $1 million.
The resolution with the U.S. government puts an end to more than four years of congressional inquiries, assessments, and investigations into the topic, which ultimately did not prevent Hyten from being nominated for vice chairman in 2019. He served for two years and did not run for re-election.
Army In the settlement struck on Wednesday in U.S. District Court in California, the federal government will pay Col. Kathryn Spletstoser, who assisted Hyten in 2017, $975,000.
She stated in a statement on Thursday, “I sincerely hope that the positive outcome in my case will encourage other survivors of military sexual violence to come forward – no matter how high-ranking the perpetrator.”
Spletstoser claimed Hyten kissed, hugged, and rubbed up against her repeatedly in 2017 while she was one of his top assistants in an interview with The Associated Press in 2019. She claimed that when she repeatedly denied him and ordered him to stop, he tried to ruin her military career.
During a Senate Armed Services Committee hearing in July 2019, Hyten vehemently refuted her accusations as his wife sat behind him and Spletstoser watched from a close distance. An internal Air Force investigation found there wasn’t enough information to prosecute him or suggest punishment. At the time, a senior Air Force officer added that investigations had not discovered any proof Spletstoser was lying. Under the condition of anonymity, the official spoke about personnel issues.
The U.S. government frequently pays out significant sums of money to resolve legal disputes, but sexual assault claims involving a senior military official are much less frequent.

Ten of the senators who opposed him cast “no” votes; among them was Sen. Joni Ernst of Iowa, the only Republican who did so, and Vice President Kamala Harris, who was then a senator from California.
According to a statement released by Spletstoser’s attorney, Ariel Solomon, the legal deal “stands out as the only known settlement paid by the government for a sexual assault case brought against a member of the United States military.”
